Wind Energy Technical Assistance with Site Plan
Technical assistance in site plan shall be provided to those municipalities that request such assistance and that administer site plans in keeping with direction given by NYSERDA Project Manager.
Specifically affected NYSARC members shall:
- Work with municipalities to consider siting and development issues as
part of the process (May 2006 - April 2008)
- Map out development process and critical path (May 2006 - April 2008)
- Investigate siting on agricultural land, considering the benefits of complementary use to preserve agriculture (May-August 2006)
For communities that presently lack appropriate regulations, but that have interest in the issue of siting wind power generators, affected NYSARC members will work with local elected leaders in developing, updating, or revising local regulations, ordinances and local laws based upon best
practices and in accordance with available material (May 2006 - April 2008)
The RPCs will provide or ensure that the following services are provided throughout the project to identified communities (and via requests) (May 2006 - April 2008):
- Assessment of current local laws and ordinances
- Procedure that includes education, outreach, development, consensus, and adoption
- Integration of wind energy with municipal comprehensive planning
- Working with municipalities with zoning
- Development of zoning revisions to regulate Wind Energy
Conservation Systems such as setback requirements, lighting and color
- Working with municipalities with no zoning
- Development of other local laws to regulate Wind Energy
Conservation Systems such as setback requirements, lighting and color
- Zoning development, revision and recodification
- Distinguish between small scale or end use wind energy projects and large scale commercial wind energy projects when formulating laws
- Decommissioning procedures for Wind Energy Conversion Systems
- Development of Payment in Lieu of Taxes (PILOT) agreements
In regard to distributing the resources available through this project in an equitable and timely manner, the GFLRPC shall devise, with the assistance and approval of the NYSERDA Project Manager, a proposed method for providing assistance and prioritizing among the affected councils that takes into consideration the requesting locality's wind resource, if a wind project proposed in that locality is in the ISO queue and its placement in the queue, if wind developers have petitioned the locality for a met tower permit, etc. (May-August 2006)
A similar formula shall be used to determine locations for the proactive outreach and education workshops for various localities (May-August 2006).
